These Terms of Service ("Terms") govern your use of the website at jmartinconstructions.com (the "Site") and any related services provided by JMartin Construction, LLC ("JMartin Construction," "we," "us," or "our"). By accessing or using the Site, by submitting any form on the Site, or by enrolling in our SMS messaging program, you agree to be bound by these Terms.

1. Use of the Site

You may use this Site for lawful, personal, and non-commercial purposes only. You agree not to:

• Use the Site in any way that violates applicable law or regulation.
• Attempt to gain unauthorized access to any portion of the Site or its systems.
• Interfere with or disrupt the Site's operation.

2. Services and Quotes

The Site provides information about our residential construction services in Western Montana. Any project quote, estimate, or schedule provided through the Site (or in subsequent communications) is preliminary unless and until we both sign a written contract specifying the scope, price, and timeline for the project. Nothing on the Site constitutes a binding offer or guarantee of services.

3. SMS Messaging Program Terms

3.1 Consent

You expressly consent to receive SMS text messages from JMartin Construction at the mobile number you provide. Consent is given by either (a) checking the SMS consent box on a form on our Site, or (b) initiating a text conversation with us.

3.2 Program description

SMS messages from JMartin Construction relate to your project inquiry, scheduling, appointment confirmations, project updates, follow-up questions, and other communications about work you have requested. We do not send unsolicited marketing or promotional SMS messages through this program.

3.3 Message frequency

Message frequency varies based on your project status. You should expect occasional messages from the time of your inquiry until your project is complete, or until you opt out.

3.4 Message and data rates

Message and data rates may apply. Standard carrier rates apply based on your mobile plan. JMartin Construction does not charge any fees for SMS messages.

3.5 Opting out

You may opt out of SMS messages at any time by replying STOP to any message you receive from us. You will receive one final confirmation message confirming your opt-out, after which you will no longer receive SMS messages from JMartin Construction. 3.7 Supported carriers

Supported carriers include AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, and other major U.S. carriers. Mobile carriers are not liable for delayed or undelivered SMS messages.

3.8 Mobile information sharing

JMartin Construction does not sell, rent, share, or otherwise disclose your mobile phone number or SMS opt-in information to any third parties or affiliates for their marketing or promotional purposes. Your mobile information is used solely to operate the SMS program you have opted into.

3.9 Consent is not a condition of purchase

You are not required to consent to receive SMS messages as a condition of purchasing any goods or services from JMartin Construction. You may contact us by phone, email, or web form without enrolling in SMS.

4. Intellectual Property

All content on the Site — including text, images, logos, photographs, graphics, and design — is owned by JMartin Construction or its licensors and is protected by copyright, trademark, and other intellectual property laws. To the fullest extent permitted by law, JMartin Construction will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our SMS program. Our total liability for any direct damages arising out of your use of the Site will not exceed one hundred U.S. dollars ($100).

You agree to indemnify and hold harmless JMartin Construction, its members, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your use of the Site.

8. Governing Law and Venue

These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Missoula County, Montana, and you consent to the jurisdiction of those courts.

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
